Terms of use
These terms are an agreement between you and Noles Technology Inc. ("we", "us") for your use of the SOAK app and website. By creating an account or using SOAK, you agree to them. Please read them, especially the sections on subscriptions and limits of liability.
1. Who can use SOAK
You must be at least 13 years old (16 in the EU and UK) to use SOAK. If you're under the age of majority where you live, you need a parent or guardian's permission. You're responsible for keeping your account secure and for everything that happens in it.
2. What SOAK is
SOAK helps you learn Mexican Spanish with short videos, word meanings and practice. We work to make translations and explanations accurate, but SOAK is a learning tool. Translations, word explanations and AI feedback in "Use it" can contain mistakes and are not professional translation or advice.
3. Videos from YouTube
Videos in SOAK are played through YouTube's embedded player. They're owned by their creators, not by us, and we don't host or modify them. By watching them in SOAK, you also agree to the YouTube Terms of Service. Videos can become unavailable at any time if a creator removes them or YouTube restricts them. SOAK is not affiliated with or endorsed by YouTube, Google or the creators featured. Creators can learn more on our creators page.
4. SOAK Pro subscriptions
- Watching in SOAK is free. SOAK Pro is an optional subscription that unlocks additional features, as described in the app.
- SOAK Pro is sold through Apple's App Store at the price shown in the app before you buy (currently $59.99 a year or $9.99 a month in the United States; prices vary by country).
- Free trial: the yearly plan may include a 7-day free trial. If you don't cancel at least 24 hours before the trial ends, you'll be charged for the first year.
- Auto-renewal: subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Your Apple ID is charged within 24 hours before renewal.
- Cancelling: open Settings on your iPhone, tap your name, then Subscriptions, then SOAK. Cancelling stops future renewals; you keep Pro until the end of the period you paid for.
- Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
- We may change prices or features. Price changes apply from your next renewal, and Apple will notify you as required.
5. Your content
You own the sentences and other content you create in SOAK. You give us a worldwide, non-exclusive, royalty-free licence to store, process and use that content to run and improve SOAK, including sending it to our AI provider to generate feedback. Don't submit anything you don't have the right to share, or anything illegal, hateful or harmful.
6. Acceptable use
Don't misuse SOAK. That includes trying to access other people's accounts, copying, scraping or downloading videos or our content, reverse engineering the app, interfering with how SOAK works, or using it for anything unlawful. We may suspend or close accounts that break these terms.
7. Our rights
SOAK, its software, design, word data, translations, the SOAK name and the cat logo belong to Noles Technology Inc. and are protected by law. We give you a personal, non-transferable, revocable licence to use the app for your own learning, subject to these terms and Apple's Standard End User License Agreement.
8. Ending your account
You can stop using SOAK and delete your account at any time in Settings. We may suspend or end your access if you break these terms or if we stop offering SOAK. If we discontinue SOAK, we'll give reasonable notice where we can.
9. Disclaimers
SOAK is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't promise SOAK will be uninterrupted, error-free or that any video will stay available, or that you'll reach a particular level of Spanish.
10. Limits of liability
To the fullest extent allowed by law, Noles Technology Inc. won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim relating to SOAK is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50. Some places don't allow these limits, so they may not apply to you, and nothing here limits rights you have under consumer protection laws that can't be waived.
11. Governing law
These terms are governed by the laws of the State of New York, USA, without regard to its conflict of law rules. Disputes will be resolved in the state or federal courts in New York County, New York, unless the law where you live gives you the right to bring a claim locally.
12. Changes
We may update these terms. If changes are significant, we'll tell you in the app or by email before they take effect. If you keep using SOAK after that, you accept the new terms.
